Workers across America got a big win today as the US Department of Labor announced it obtained a consent judgement against staffing firm Advantix Logistics Corp. and owner Michael Mortorano. The judgement requires them to pay $910,000 in back wages and liquidated damages to 289 workers after failing to pay overtime and keep accurate records of hours worked.
The workers- who loaded and unloaded freight from containers and pallets- worked for upwards of 70 hours a week in warehouses yet were not paid an overtime premium for working more than 40 hours.
This isn’t the first judgement against Advantix Logistics -in November 2022, the firm was required to pay $65,000 in damages to a former employee who the company fired after they complained about not being paid for all hours worked.
Solicitor of Labor Jeffrey Rogoff in New York equated this decision with a warning to all staffing agency employers saying, “This consent judgment makes clear to all staffing agency employers that, like Advantix Logistics Corp., they will be held accountable if they fail to pay employees their legally earned wages.”
